Karl asks: "Should the enactments of bodies of
internet governance be of limited duration so that
they need to be re-affirmed periodically?"
For what it's worth, this is a topic that I have
raised as well directly with several ICANN Board
directors specifically in response to the ongoing
circumvention of the Expired Domain Deletion Consensus
Policy (by that segment of the registrar community
that has incorporated "direct transfer" policies into
their Terms of Service Agreements -- these policies
force you to transfer an expiring name to the
registrar or their agent for auction purposes rather
than allowing the domain to return to the pool of
available names).
If ICANN's consensus policies are not enforced and are
routinely ignored by many major registrars, then
either the policy itself or the approach to
enforcement needs to be periodically revisited.
Perhaps all of these consensus policies should have a
sunset clause...
