Historically, the US Commerce Dept. responds to very specific stakeholders:
the IPR lobby in Washington, foremost among them; governments collectively
through the GAC; "national security" claimants in the domestic polity; big
telcos and Internet businesses.

That's strange, but I could have sworn that several of these are already
active in ICANN itself. 

So, given that, what difference does it make if the JPA exists or is
removed?
