Privacy is one of the central challenges of our time and a pressing topic in today’s discussions on platforms, algorithms and policy making. The APC is a powerful forum for academics and advocates from around the world to move the field of privacy research forward. The conference is an important venue for privacy scholars from many different disciplines. The presence of Palantir as a sponsor of this conference legitimizes the company’s practices and gives it the opportunity to position itself as part of the agenda. This is deeply problematic and extremely regrettable. Palantir’s business model is based on a particular form of surveillance capitalism that targets marginalized communities and accelerates the use of discriminatory technologies such as predictive policing, for which the company has already been heavily criticized [1, 2]. Among Palantir’s public clients are police agencies and defense departments from all over the world. In the last year, Palantir has helped the Trump administration to find and deport asylum seekers, undocumented immigrants and refugees, raising serious concerns about wide-scale human rights violations [3]. While the company is largely secretive about its operations, it reportedly collaborated with Cambridge Analytica [4, 5], hedge funds, banks and financial service firms [6]. Despite criticism over Palantir’s sponsorship since the conference’s 2015 edition, APC’s sponsorship strategy has not changed. This stance has consequences: it contributes to the marginalization and exclusion of scholars that otherwise would have participated and enriched the conversation at these events. Hence, it also impacts APC’s ability to nurture public debate on privacy. Palantir has also surfaced as a sponsor at a range of other prominent privacy and technology policy events. Due to similar concerns, some of these conferences have discontinued Palantir sponsorship, an example that we hope to see replicated. Given the political, economic and societal implications of privacy today, the funding strategies of our conferences matter more than ever. However complicated the process may be, it is time to develop sponsorship criteria and guidelines that ensure academic independence and proper consideration of human rights. We therefore call for: 1. The meeting of the Global Forum on Cyber Expertise (GFCE) will also take place in parallel to this event. On 19 September, the Commission will host its public Cyberstability Hearings between 14:00-18:00 at the Marina Bay Sands Expo and Convention Centre. The Hearings are open to all SICW participants and will feature discussions between Commissioners, governmental advisors, private sector and civil society representatives on matters pertaining to international peace and security in cyberspace. They will provide advanced insight into and discussion about some of the current developments and thinking on norms of responsible behaviour in cyberspace, implementation and enforcement mechanisms, and the way forward for the international security architecture in cyberspace. On 20 September, the Commission will convene in a closed session to advance its agenda and the discussion on governance. This meeting builds on previous work undertaken by the Commission, including the results of Bratislava and subsequent conferrals in Tel Aviv. On this occasion, GCSC members will discuss the Singapore Norm Package, a working document containing norm proposals formulated by commissioners. A consultation on the content of this draft document is currently underway in the mailing list of GCSC’s Research Advisory Group (RAG). Best, Alex ———————— Dear all, On 13 September 2018, the European Court of Human Rights released its judgement in our case against the UK's mass interception powers and intelligence sharing arrangements in the UK (link to the Court’s press release here: http://hudoc.echr.coe.int/eng-press?i=003-6187848-8026299) The case challenged the UK bulk interception of communication that happens to traverse the UK and to store the content of these communications as well as any related communications data; and the UK capacity to obtain similar bulk access to communications and data intercepted by the intelligence services of other states, such as the US. The top lines of the judgement are: The UK’s historical bulk interception regime violated the right to privacy protected by Article 8 of the European Convention on Human Rights (ECHR) and to free expression, protected by Article 10. The interception of communications data is as serious a breach of privacy as the interception of content, meaning the UK regime for bulk interception of communications data was unlawful. The UK’s regime for authorising bulk interception was incapable of keeping the “interference” to what is “necessary in a democratic society”. Here’s our analysis of the decision. 'Free global flow of data' is the key mantra of e-commerce proposals at global trade forums including the WTO, and 'data localisation' a term that is out-rightly condemned as being sought only by state control freak developing countries, bent upon data authoritarianism.  Great dangers of the latter no doubt exist, but one is unclear how they get addressed by sending our data to US and NSA's warm embrace of it. But there are people in many countries, including in India, who openly argue that they are happier to have their data in the US than India, meaning they feel more protected by the US government than India's.  On the other hand, there are many kinds of domestic economic development imperatives that require some kinds of data localisation This IT for Change policy brief attempts to look data localisation from the angle of ensuring the rule of law, and domestic digital industry development , 'Data localisation: A matter of rule of law and economic development '. Broadly based on it, a shorter piece, was published as an oped in The Hindu today, 'Bringing data under the rule of law ' .
