Not to be subjective, i.e. legally acceptable "Network neutrality" 
must be mesurable. So, it can only be a technical notion.

The provision of a network service is said to be technically neutral 
when every system participating in the end-to-end process can 
randomly be replaced by its technical equivalent from any other
